Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the FoodFlex application (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

FoodFlex reserves the right to update these Terms at any time. We will notify you of material changes via in-app notification or email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

FoodFlex is a Shopify embedded application that provides food businesses with meal customization, visual meal building, nutrition tracking, allergen management, kitchen display, order management, subscription management, and related services.

The Service is provided “as is” and is subject to ongoing development and improvement. Features may be added, modified, or removed at our discretion.

3. Account Registration

Access to FoodFlex requires a valid Shopify store and installation via the Shopify App Store. By installing the app, you authorize FoodFlex to access your Shopify store data as described in our Privacy Policy.

You are responsible for maintaining the security of your Shopify account and any API keys generated through FoodFlex. You must notify us immediately of any unauthorized use of your account.

4. Billing & Subscription Tiers

FoodFlex offers multiple subscription tiers (Basic, Professional, Enterprise) with different feature sets and usage limits. Billing is managed through the Shopify Billing API.

  • Subscription charges are billed through your Shopify account on a monthly or annual basis
  • You may upgrade, downgrade, or cancel your subscription at any time through the FoodFlex billing page
  • Downgrading may result in loss of access to features exclusive to higher tiers
  • Refunds are available within 30 days of initial purchase for paid plans

5. Data Ownership

You retain full ownership of all data you create through FoodFlex, including meal configurations, nutrition data, customer profiles, and order history. FoodFlex does not claim any ownership rights to your content.

Upon uninstallation, all merchant data is deleted in accordance with Shopify’s data protection requirements and our Privacy Policy.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service, its servers, or any related systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Public API in a manner that exceeds rate limits or places unreasonable load on the Service
  • Resell, sublicense, or redistribute the Service without written permission
  • Upload malicious content, including but not limited to malware, scripts, or code designed to disrupt the Service

7. Service Availability

FoodFlex strives to maintain high availability but does not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice when possible.

FoodFlex is not liable for any downtime, data loss, or service interruptions caused by factors outside our reasonable control, including but not limited to Shopify platform issues, internet connectivity problems, or force majeure events.

8. Limitation of Liability

To the maximum extent permitted by law, FoodFlex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.

FoodFlex’s total liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

9. Termination

You may terminate your use of the Service at any time by uninstalling the FoodFlex app from your Shopify store.

FoodFlex may suspend or terminate your access to the Service if you violate these Terms, engage in abusive behavior, or fail to pay applicable subscription fees.

Upon termination, your right to use the Service ceases immediately. Data deletion follows the procedures outlined in our Privacy Policy.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless otherwise required by applicable law.
